The latest version of the CLARITY Act makes that shift explicit.
Released on September 10, the 630-page Senate draft creates rules for what it calls “non-decentralized finance trading protocols.” Instead of simply asking whether a project calls itself DeFi, regulators would examine whether a person or coordinated group still has the power to control or materially alter how the protocol works.
